“THE BHA was last night under pressure to give a full account of the mistakes that led
to the mishandling of the Jim Best inquiry as it emerged a rehearing of the case may
not be able to take place until at least September.


“Best’s solicitor Harry Stewart- Moore said it was time the regulator explained to the
sport how things went so badly wrong that an appeal board had to order an
unprecedented second inquiry and quash findings of guilt against the Lewis trainer over
an appearance of bias and insufficiency of reasons.  


“And Rory Mac Neice, the Professional Jockey’s Association lawyer who raised concerns that
the BHA was a client of Matthew Lohn 12 months before he was chosen to chair the Best inquiry,
said an application should be an absolute priority to repair the reputational damage the affair
has wrought on the disciplinary function.


“At the Best appeal the BHA issued three unreserved apologies to the trainer and agreed to pay
legal costs likely to be in the region of £50,000 after failing to disclose that Lohn carried out
other work, for which he was paid £55,000, when he also chaired the disciplinary hearing at which
Best was convicted of instructing a jockey to stop two of his horses.




“The BHA has promised to be “fully open and transparent about the wider matters

that have arisen” once the case was over and yesterday indicated it was sticking

 to that line on legal advice until after rehearing in order not to risk prejudicing

 the case.



“Stewart –Moore said: “One of the main points of Tuesday’s hearing was for the

BHA to put all of its cards on the table as regards its integrity departments

woeful treatment of Best.



“For the BHA to now say that concerns regarding Mr Best’s position at the

rehearing is preventing it from explaining to the industry how this terrible

mess has been allowed to come about is therefore not only rather rich but
 entirely illogical.

“We do not see how the BHA can properly exercise its integrity function until a
full and frank explanation of the Best debacle is provided. “

“The timing of the rehearing will depend on the availability of key participants
including Best’s in-demand barrister Jonathan Laidlaw QC and the early indication
were it may not be scheduled until September or October.

“Mac Neice said: “If the BHA’s position is that they are not going to provide an
explanation until after the rehearing and the rehearing isn’t going to be until
September, the BHA needs to explain why it thinks it is appropriate to wait so
 long.

“What prejudice does the BHA say there will be in providing an explanation now?
“The difficulty for the BHA is it has to weigh the impact on participants confidence
 in the disciplinary system by this very lengthy delay in having any indication from
 the BHA as to what it was thinking.

“It seems to me an absolute priority of the BHA to try to repair the hit in confidence
this whole process will have had.

“I would urge the BHA to provide a full and frank explanation now and to start the
 process of putting in place a disciplinary panel system that does withstand scrutiny
 and, as importantly , has the confidence of the people who use it. “

“The BHA has committed to making a full statement at the appropriate time and
agreed to address perceptions of fairness through its integrity review.

“No claim of actual bias was made against Lohn, and the BHA chief executive
Nick Rust acknowledged after the appeal that disciplinary hearings not only had to be seen
to be fair.“Lohn also said he was not in a position to respond to the outcome of the
Best appeal.

“My position remains unchanged , “ he said yesterday.

“The BHA are not saying anything and indeed as a panel chair it would be highly inappropriate
to say anything “I am pretty sure that will be my position/ I can’t see that that will change. They
 are my client and I can’t say anything. “

Gilligan’s legal team seek costs and apology after Best appeal.
“THE solicitor representing Paul Gilligan yesterday said he would be seeking an apology
 from the BHA and an offer to pay legal costs, just as trainer Jim Best received at his
 appeal hearing on Tuesday. “


“Cheltenham Festival-winning trainer Gilligan won a stay of his six-month suspension
for sending a horse who had competed at an unrecognised meeting in Ireland to race at
Uttoxeter in 2014 – until after the completion of the Best appeal, having been convicted
In April by a panel chaired by Matthew Lohn.


“Michael Keane who represents Gilligan, argued the decision was “substantially unfair and
prejudicial” because the BHA was a client of Lohn.

“From my own perspective I will be expecting to be hearing from the BHA shortly to see
if they agree to do the same as they have done with the Best case, “ Keane said yesterday.

“That is to give him an apology and pay our costs, I find it incredible when the BHA were warned some time prior to the Best case about the potential conflict or the perception of a conflict that they didn’t deem it of any consequence.

“In any tribunal you have to have a proper division of individuals in terms of who is at the top table . It is a long-held premise in any law, it doesn’t matter the jurisdiction. “

“Gilligan has lodged an appeal, which is set to be heard on July 18,  but Keane questioned whether that hearing or a rehearing should now go ahead.


“I think it’s not a good idea, “ he said. “there is a finding of guilty against my client already

“The one thing that has been lost in all this is the terrible pressure and upset visited on
Jim Best and his family and my own client and his family.

“They are small trainers and they are still in limbo. They can’t They can’t make a plan
for their careers, they can’t get new owners. It’s even worse than being back at square
one.

“I would have thought the BHA should have dealt with these cases and agreed to move
 on with their new procedures.

“If they insist on a rehearing we will be going over to deal with it fully and forcefully. “  ends:

FURTHER THOUGHTS ON THE EU REFERENDUM



JMC: Obviously it could be said, of course Britain should stay in the EU especially as we have helped form the EU from the very start, kept on through good times and bad over what is now 43 years, 28 countries attempting to work together, for the benefit of global peace. What could possibly be wrong about that? But there is something wrong in the EU the findings are that we are being restricted, taken over by a dictatorial force, similar to the male Tory Cameron/Osborne Division.

If we vote to stay in the EU we will never get our country back. We will be trapped for ever.
If we vote to leave however the vibes are that we will get our country back. We will not have to go on paying huge sums of money to the EU every day either. We can go ahead and form our own trade agreements. We can take charge of our own border.


We can still go on working for global peace, but on our own terms. We will be free from the shackle’s of the European Court of Justice in Brussels.  We will need to sort our own legal justice system to rid ourselves from the dark - age Royal Courts of Justice in London. And build a new justice system that needs to work for us all. The vibes are that the only way we can address the EU problems is by leaving.
