Dwyer rides on as BHA agrees stay of penalty

DWYER returns to the saddle this afternoon after the BHA disciplinary panel agreed to a stay of penalty over the
Derby-winning jockey's controversial
56-day ban, which had been due to start yesterday.
"Dwyer

expected, the Marlborough-based freelance has lodged an application calling on
the regulatory body to disregard the suspension imposed by the Bloodhorse Illiterate Royal Western India Turf Club
after he was found guilty of preventing Ice Age running on her merits at Mahalaxmi racecourse in Mumbai on February 17 2013. Where is the Indian Equus Zone? Where is the British Equus Zone?
"Despite
the 38-year-old denying the charge, the ban was subsequently increased to eight
months, before reverting to the original 56 days following an appeal on
Saturday.
"Dwyer
said: "I've still got it hanging over me but at least I can be assured
I'll get a fair hearing at the BHA, which I certainly didn't get in India . I know
they're keen to hear it as soon as possible and that would suit me.
"I've
already appointed Graham McPherson QC to represent me, and Paul Struthers
[Chief executive of Professional Jockeys Association] has worked very hard in
getting the wheels in motion, so hopefully it won't take too much longer before
it's heard. "
"BHA
spokesman Robin Mounsey said: "The BHA has today received an application
from Martin Dwyer that the suspension imposed by the RWITC not be reciprocated.
This application will be considered by the disciplinary panel at a date to be
determined. The date of the hearing will be dependent upon all parties
receiving full documentation from RWITC of the disciplinary processes to date.
"
"Mounsey
added: "The BHA has also received an application that the suspension
should not apply in Britain
until the non-reciprocation application hearing is held. The disciplinary panel
has approved this application and Dwyer is free to ride in Britain for the
time being.
"If
the full hearing cannot be arranged before September 24 it will be necessary
for a further application to be made for an interim stay of the ban. "
"Dwyer
has a busy week in which he also takes in meetings at Kempton, Chepstow,
Wolverhampton and a Saturday double-header of Doncaster and Kempton Park .
He can also look forward to riding Stepper Point in the Group 3 Qatar Prix du
Petit Couvert at Longchamp on Sunday if Muir declares the recent Beverley
Bullet winner. "
